If the officer believes you are under the influence, he will administer a field sobriety test (FST), which you may refuse. The officer may arrest you for OVI whether you take the test or not, and then he will take you to his station and administer a Formal Breath Test to determine if your blood alcohol level exceeds 0.08%. If you refuse that test, the state will automatically suspend your driver's license for 1 year. If you take that test and fail, the state will automatically suspend your driver's license, and you will be charged with OVI (DUI or DWI).
